New York Gay Divorces and Marriages?
By divorce help on Feb 26, 2008 in Divorce - General
Although New York doesn’t recognize gay marriages (yet), it looks like an activist judge will try to make it happen soon. How? The judge is allowing a lesbian couple married in Canada to pursue a divorce in New York state court. If the case is allowed to proceed to a divorce decree, you can expect gay marriage to follow shortly thereafter.
This will continue to be a hot issue throughout the United States. Some advocate a ban imposed by federal law, others say it should be decided on a state-by-state basis without federal government interference, others want it legalized everywhere, and yet another group wants to take a middle road by creating same-sex civil unions that have all the legal rights of marriage without calling it “marriage.”
We’ve already already seen custody fights when same-sex couples split. It is just a matter of time before gay and lesbian couples get to experiences all the headaches of divorce that too often follow a marriage. Stay tuned. This will be working its way through the court systems for another decade or so.
